Please read these Terms of Service ("Terms") carefully before using the website at muskokadockservices.ca (the "Site") operated by Muskoka Dock Services ("we," "us," or "our").
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.
1. Nature of Service — Referral Matching Only
Muskoka Dock Services is a referral matching service, not a contractor. We connect property owners seeking dock installation, removal, or repair services with independent third-party contractors. We do not perform any dock work ourselves, do not employ dock contractors, and are not a party to any agreement between you and a contractor.
By submitting a quote request through our Site, you are requesting that we connect you with one or more independent contractors who may be able to assist with your dock project. We do not guarantee that a contractor will be available, that any contractor will provide a quote, or that you will engage any contractor as a result of using our Site.
2. Disclaimer Regarding Contractors
Independent contractors referred through Muskoka Dock Services are not employees, agents, or representatives of Muskoka Dock Services. We do not:
- Employ, supervise, or control any contractor referred through our service
- Verify, certify, or warrant the qualifications, licensing, insurance, or workmanship of any contractor
- Guarantee the quality, timeliness, or outcome of any work performed by a referred contractor
- Accept liability for any acts or omissions of a referred contractor
You are solely responsible for evaluating any contractor, verifying their insurance and qualifications, entering into a written contract with them, and resolving any disputes with them directly. We strongly recommend requesting proof of insurance from any contractor before authorizing work on your property.
3. Accuracy of Information
We make reasonable efforts to ensure that information on the Site — including service area coverage, timing guidance, and dock information content — is accurate and up to date. However, we do not warrant that information is complete, error-free, or current at all times.
General information on our Site regarding dock regulations, permits, timing, and maintenance is provided for informational purposes only and does not constitute professional or legal advice. Always consult your local municipality and qualified professionals regarding your specific situation.
4. Limitation of Liability
To the maximum extent permitted by applicable law, Muskoka Dock Services and its principals, affiliates, and agents shall not be liable for:
- Any loss, damage, or injury arising from the actions or omissions of any referred contractor
- Any direct, indirect, incidental, special, or consequential damages arising from your use of the Site or our referral service
- Any loss resulting from your reliance on information published on the Site
- Any failure to connect you with a contractor or failure of any contractor to provide services
In all cases, our total liability to you for any claim arising from your use of the Site or service shall not exceed zero dollars ($0), as we provide our referral service at no charge to you.
5. Indemnification
You agree to indemnify and hold harmless Muskoka Dock Services and its principals from any claims, losses, damages, or expenses (including reasonable legal fees) arising from: (a) your use of the Site; (b) your interaction with any referred contractor; (c) any project undertaken by a referred contractor on your property; or (d) your violation of these Terms.
6. Use of the Site
You agree to use the Site only for lawful purposes and in a manner consistent with these Terms. You must not:
- Submit false, misleading, or fraudulent information in any form submission
- Use the Site to solicit other users or contractors for purposes unrelated to dock services
- Attempt to circumvent, disable, or interfere with any security feature of the Site
- Use automated tools to access or collect data from the Site without our written consent
7. Intellectual Property
All content on the Site — including text, graphics, logos, and code — is owned by or licensed to Muskoka Dock Services and is protected by Canadian copyright law. You may not reproduce, distribute, or create derivative works from any content on the Site without our prior written consent.
8. Privacy
Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Ontario.
